Terms of Service
1. Acceptance of Terms
By using this website and/or purchasing photography services, you agree to be bound by these Terms of Service.
2. Copyright Ownership
The Photographer retains full copyright ownership of all photographs taken during any session. This includes, but is not limited to, the right to reproduce, distribute, display, and create derivative works from the photographs. The Client is granted a limited, non-exclusive license to use the photographs for personal, non-commercial purposes.
3. Usage Rights
The Client may use the photographs for personal use, such as printing, sharing on social media, or creating personal gifts. However, the Client may not use the photographs for any commercial purpose without the express written consent of the Photographer. This includes, but is not limited to, selling the photographs, using them in advertising or marketing materials, or using them to promote a product or service.
4. Photographer's Right to Use Photos
The Photographer reserves the right to use any photographs taken during a session for advertising, marketing, or other business purposes. This may include, but is not limited to, displaying the photographs on the Photographer's website or social media pages, using them in promotional materials like on business cards etc., or submitting them to contests or publications.
5. Model Release
If the Client wishes to prevent the Photographer from using the photographs for advertising or marketing purposes, a separate model release agreement must be signed by both parties. This agreement will outline the specific terms of use for the photographs. Agreement must be signed within 30 days of delivery of photographs.
6. Payment Terms
Payment for photography services will be split into two payments: the Retainer/Downpayment (Non-Refundable) is due at the time of booking, and the second payment is due on the day of the shoot. The Photographer reserves the right to cancel or reschedule a session if payment is not received.
7. Cancellation Policy
The Client may cancel a session up to 48 hours before the scheduled time. If the Client cancels within 48 hours of the session, the second payment will be canceled and will not need to be paid.
8. Limitation of Liability
The Photographer is not liable for any damages arising from the use of the photographs. The Client agrees to indemnify and hold the Photographer harmless from any claims, damages, or expenses arising from the Client's use of the photographs.
9. Changes to Terms of Service
The Photographer reserves the right to modify these Terms of Service at any time. Any changes will be posted on this website, and continued use of the website or purchase of services constitutes acceptance of the modified terms.
10. Governing Law
These Terms of Service are governed by the laws of Texas and the United States of America.
